BAD PAINT JOB ON HOUSE? CONTRACTOR full of excuses!!?

HE WAS CONTRACTED MID JULY TO PAINT OUSTIDE OF OUR HOUSE AND STILL HASN'T FINISHED BY THE BEGINNING OF SEPTEMBER!!!!!


We paid him half up front, with the balance to be paid on completion. The contract we signed said he would be finished no later than August 9th.


The job he has done so far is patchy in places, dribbles of different color of paint runnning down side, bare exposed wood in parts etc, etc, .


He always has excuses , turns up when he likes ! Rarely has done a full days work.





HELP...Legally can he come after us for balance if we find someone else to finish this botched job.....

file a complaint against him with the contractors licensing board. Then notify him he's done and you will be finding a different painter to finish the job and that HE will be billed any difference above and beyond what it should have cost you to begin with in total. If he gives you any grief, or does not pay the backcharge to him, sue his ***.

Hasn't he breached the contract by not completing the job by August 9th?





My suggestion would be to take pictures of the job he's done so far (you can also include in the picture the day's paper with the date legible). If he does decide to take you to court for the balance due, you'll have both the contract stating completion date and pictures proving the job wasn't completed on time nor in a professional manor.





I would go ahead and hire another painter to do my house. And if the original painter sues you, countersue for the half you paid him.
he cant come after you if his work is so horrendous... take lots of pictures. You may even be able to sue him for the deposit you gave him. he already breached the contract by not having it completed in the time frame he said he would. He broke contract. I would say tell him ';look, you arent getting this done in a timely fashion, and your work is below par. Fix your mistakes and finish my house in x weeks or I will take it to another contractor';





And then take him to the peoples court!!








But seriously, he breached contract. Just make sure you have YOUR copy of the contract, and take pictures of the work he has done so far











As for the money up front thing, it really isnt uncommon for contractors to ask for a certain percentage up front, especially if they are buying supplies etc. just dont give him any MORE money, whatever you do. that shows that you are satisfied with what he has done so far. go get estimates from other contractors and their opinions as well. try asking friends/family/neighbors for contractors they have used and reccomend.
This is a hrad lesson learned. Always check for a contractors license and never give money up front. That is a huge red flag. Any contractor worth his weight will get his money AFTER the job is done.

If you contact the consumer affairs board and ask them if he is licensed, then tell him you are going to turn him in, he will have no problem taking a hike. First of all he can only ask for 10% or $100.00 up front, whichever is greater. You may be able to get your money back also. The consumer affairs board is for the consumer. They do not fool around. If you had a competition date on the contract, and he didn't meet it, he's in trouble. They will send a rep out to check out your complaint. All licensed contractors have to put their license number on their bids, their business cards, and any advertising. Don't give him any more money.
